Terms and Conditions for training and e-learning courses

Lake Learning Legal Notices and Terms and Conditions

The following constitute the Terms and Conditions to which applicants agree when booking any Lake Learning face-to-face training or e-learning courses (Terms and Conditions). Throughout the Terms and Conditions Lake Learning means Lake Creative Limited, trading as Lake Learning. Lake Learning reserves the right to review and update these periodically.

Registration and Booking

  • Registration with Lake Learning (creating an account)
  • Before you book a face-to-face training course or e-learning course we require you to register to create an account and provide certain information about yourself. In doing this, you agree to:
  • provide true, accurate, current and complete information about yourself as prompted by the relevant registration form
  • maintain and promptly update the data we hold by logging into your account and updating via ‘My profile’.
  • Booking a face-to-face training or e-learning course
  • Face-to-face training and e-learning courses can be booked via the booking forms available on the Lake Learning Academy website. You need to be registered with Lake Learning before you can do this as you will be required to log in or create your account to complete the form.

When you submit a booking for an online course, your submission represents an offer to Lake Learning to book you onto the course you selected. On submission of the face-to-face training course or e-learning course form, you will receive an automated summary email of your selection.

Lake Learning will accept your offer by entering your booking onto the Lake Learning system and sending you an email confirming that you have been booked, together with information on starting your learning.

When you are given access to the Learning Academy, you are granted a non-exclusive, non-transferable, revocable licence to use the Learning Academy materials.

  • Prices, discounts and sales taxes/VAT
  • Notice of new pricing will be given in advance, but Lake Learning reserves the right to change prices listed without notice.

If three or more people from the same organisation book onto the same face-to-face or e-learning training course they qualify for a 25% discount off the combined course fees. This discount only applies to Lake Learning courses and cannot be used in conjunction with any other offer. Places are subject to availability.

  • Payment
  • Fees must be paid at the point of booking via Worldpay’s secure online payment process. If you have an applicable discount code, this must be entered at the time of booking, as the discount cannot be applied retrospectively.

We cannot accept payment by instalments.

We will raise an invoice for businesses.

All major credit and debit cards are accepted. A receipt will be sent to you by email from Worldpay confirming payment. Worldpay will receive the information needed to verify and authorise your payment card and to process your order and is under strict legal and contractual obligations not to disclose this information to third parties.

Please note that if you do not provide accurate details (including type of card and number) or if your credit card company does not authorise payment, your application will be deemed void. Lake Learning will not accept any liability for costs incurred as a result of applications deemed void in this manner.

Sales taxes (VAT, TVA etc.) are charged at the applicable rate depending on the product and/or customer.

All services provided by Lake Learning are on the basis of these Terms and Conditions and if you wish to engage any Lake Learning services we shall only provide them if you accept the Terms and Conditions.

1.Lake Learning Academy face-to-face training courses

After booking onto a face-to-face training course you will be given access to Lake Learning’s Learning Academy from the date your booking is processed until after your training course is complete. Please ensure you download all the documents your need prior to your completion date. By using the Learning Academy you agree to these Terms and Conditions; if you do not agree to these terms, you cannot use the site.

Whilst we make every effort to keep changes to the site to a minimum, we reserve the right to make any amendments to the terms and conditions at any time to reflect changes affecting our business, including but not limited to, changes in technology, payment methods and legal and regulatory requirements. By continuing to use this site you agree to accept any changes made to the terms and conditions.

The face-to-face training course fees include: tuition on the day(s), all relevant course materials downloaded by you from the Lake Learning Academy site (but please note that under no circumstances will any electronic version be provided, whether before, during or after the training course), refreshments and lunch.

1.1 Ownership and intellectual property rights

All Learning Academy materials, whether on the Learning Academy website or at a Learning Academy training day, are owned by Lake Learning. All intellectual property rights in all materials available from the Learning Academy, including the design, graphics and text of all printed materials and the audio of all webinars and podcasts, are owned by Lake Learning. No Learning Academy content may be copied, reproduced, uploaded, posted, displayed or linked to in any way, in whole or in part, without Lake Learning’s prior permission. Any such use is strictly prohibited and will constitute an infringement of Lake Learning’s intellectual property rights.

1.2 Special requirements at the face-to-face training course

Lake Learning will make every effort to accommodate special requirements that have been notified in advance on the booking form.

1.3 Health and safety at the face-to-face training course

You must comply with all health and safety rules and regulations and any other reasonable security requirements that apply at the premises at which the training courses are provided.

1.4 Invitation letters

Should a participant require an invitation letter from Lake Learning, we are able to provide this as long as full payment of the training course fee has been received.

1.5 Behaviour

Lake Learning reserves the right to remove any delegate from a training course whose behaviour is deemed inappropriate by Lake Learning or its trainers. In these circumstances, Lake Learning will neither refund any fees nor reimburse any other costs.

1.6 Instructors

Lake Learning shall provide instructors to present the training course as it, in its sole discretion, deems fit and Lake Learning shall be entitled at any time to substitute any instructor with any other person who, in Lake Learning’s sole discretion, it deems suitably qualified to present the relevant course.

1.7 Liability

Lake Learning does not accept responsibility for any Lake Learning instructor as a result of information in, or views expressed on, its training courses including course materials. Opinions expressed are those of individual instructors and not necessarily those of Lake Learning. Participants should take professional advice when dealing with specific situations.

2.Lake Learning Academy e-learning courses

After booking onto an e-learning course you will be given access to Lake Learning’s Learning Academy on the terms of the licence referred to below for a period of 90 days when purchasing an individual unit, and 365 days when purchasing the annual licence. By using the Learning Academy you agree to these Terms and Conditions. If you do not agree to these Terms and Conditions, you cannot use the site.

2.2 Technology

Lake Learning does not warrant that the provision of any content online will always be available or be uninterrupted, timely or error-free, that defects will be corrected or that such content is secure or free from bugs, viruses, errors and omissions.

2.3 Liability

Lake Learning does not accept responsibility for anyone Lake Learning as a result of information in, or views expressed on its training courses, including course materials. Opinions expressed are those of individual instructors and not necessarily those of Lake Learning. Participants should take professional advice when dealing with specific situations.

  • Cancellation
  • 1 Cancellation of a face-to-to face or -e-learning training course
  • If you notify Lake Learning in writing (by email or post) that you wish to cancel a face-to-face training or e-learning course 1 working day before the start date of a course, you will be entitled to a full Refunds will be processed within 28 days of receiving your request via bank transfer to the original payer.

If you withdraw for any reason less than 1 day before the start date of a course, no refund will be issued but you may transfer your place on the course to a substitute. Substitutions should be notified to Lake Learning at least 48 hours prior to the course start date. If you fail to attend the course on which you are booked without giving prior notice to Lake Learning, we are unable to refund the course fees or offer a transfer.

3.2 Transferring your place on a face-to-face or e-learning training course

There is no charge for transferring your booking to the same course on an alternative date provided you notify Lake Learning in writing not less than 1 working day before the start and if there is availability. If you transfer your booking you will not receive any refund, and you will not be entitled to transfer more than once. You must make any request to transfer a course in writing, which may be sent by email to: hello@lake-creative.co.uk
